Ridez Host Agreement
Version 7.2, 13 October 2026
This agreement is between:
Ridez Marketplace LLC, a Wyoming limited liability company (“Ridez”, “we”, “us”); and
the host who accepts this agreement as set out under “How you accept this agreement” below, named in their Ridez host account or in the signature block, who owns the cars listed under this agreement (“you”).
Ridez is a peer-to-peer car-sharing marketplace, not an insurance company, and it sells no insurance. On the date of this version Ridez holds no insurance policy for trips, so liability to other people during a trip comes first from the insurance you must carry (section 15). Part 2, the Host Protection Plan, is Ridez’s own promise to reimburse damage to your car; it is not an insurance policy and does not replace yours.
This agreement has two parts, and you accept both. Part 1 sets out how you list cars on Ridez, how you are paid, the insurance you must carry, and what each of us is responsible for. Part 2 is the Host Protection Plan: the plan you choose for each car, its plan fee and deductible, and how Ridez reimburses physical damage to your car during a trip.
How you accept this agreement. You accept this agreement, Parts 1 and 2, by creating a host account on Ridez’s “Become a host” page. Beside the sign-up button, that page tells you that creating a host account means you accept this agreement, and links to it, so you can read it before you sign up. Ridez records the version you accepted and the date. Once you accept, the payout rules in this agreement apply to your trips, including trips booked before you created your host account. You may also sign the signature block at the end; it records the same acceptance.
Part 1 — Listing and hosting on Ridez
1. Words used in this agreement
- Guest agreement means Ridez’s Guest Car-Sharing Agreement that each guest signs for each trip. In it you are the “Shared Vehicle Owner”. This agreement and the guest agreement together are the peer-to-peer car-sharing program agreement under Fla. Stat. § 627.7483(1)(g). Ridez is a peer-to-peer car-sharing program, not a rental car company, and no trip is a rental.
- Car-sharing period has the meaning in Fla. Stat. § 627.7483(1)(b): it starts when delivery of the car to the guest begins (if you or Ridez deliver it) or otherwise when the guest takes control at or after the booked start time, and ends at the earliest of: the end of the booked period if the car is returned to the agreed place; return to another place you and the guest agreed through Ridez; or when you take back possession and control.
- Trip means a booking made through Ridez, and its car-sharing period.
- Trip Photos means the photos of the car taken at pickup and at return, which are the record of the car’s condition.
- Car group means Lowkey (a day price under $100), Standard (a day price of $100 to $199) or Premium (a day price of $200 or more), using the day price shown to guests.
- Cosmetic damage means scratches, scuffs, chips and small dents that do not affect the car’s safety or how it drives. The guest agreement uses this same definition, word for word.
- Promotional credit means Ridez credit that Ridez gives a guest as a promotion or as goodwill, and that did not come from a payment the guest made.
- Host Protection Plan means the plan in Part 2, and plan fee means the share of your pay that Ridez keeps for the plan you chose (section 22A).
- Platform Liability Policy means a liability insurance policy that a licensed or eligible insurance company issues to Ridez for trips booked through Ridez. Ridez does not hold one on the date of this version.
- Switch Date means the date a Platform Liability Policy first takes effect. Switch Notice means Ridez’s written notice to you of that policy (section 15.6).
- Support hours means 11:00 a.m. to 11:00 p.m. Eastern time, every day.
2. What Ridez does
Ridez runs a car-sharing marketplace. Guests find your cars, book them and pay through it. Ridez does not own your cars, and they stay yours. You may take a car off the platform whenever you need it; tell us when one leaves your fleet. Taking a car off does not cancel trips already booked; cancelling them is governed by section 12.
Every guest signs the guest agreement for each trip. Its rules on who may drive, where the car may go, deposits, damage and accidents apply to every trip on your cars.
2A. Florida notices
Statutory disclosures: Fla. Stat. § 627.7483(4) and (6)(a).
Florida law (Fla. Stat. § 627.7483) requires Ridez to tell you the following before you list a car:
(a) Liens. If your car has a lien or loan against it, sharing it through Ridez, including sharing it without physical damage coverage, may violate your contract with the lienholder. The Host Protection Plan is not physical damage insurance and does not meet a lienholder’s requirement for it.
(b) Ridez may seek repayment from you. Ridez may seek indemnification from you for economic loss caused by your breach of this agreement, including a payment Ridez makes because your policy lapsed or excluded the trip (sections 15.3(b) and 15A).
(c) Your insurer will not defend you against Ridez. A motor vehicle insurance policy issued to you for your car does not provide a defense or indemnification for any claim Ridez makes against you.
(d) Ridez’s insurance is trip-only. Any insurance Ridez maintains on you and the guest (from the Switch Date, section 15.6) is in effect only during each car-sharing period. For any use of your car by the guest after the car-sharing termination time, you and the guest may not have insurance coverage.
(e) Prices. Your daily rate is the rate you set (section 4). Ridez charges you no fee for any insurance. The cost to you of the Host Protection Plan is the plan fee and the deductible of the plan you choose for each car, shown in section 22A; the plan fee comes out of your pay for each trip. Guests pay the price of the protection plan they pick (Minimum, Standard or Maximum) shown at booking.
(f) Your own policy may exclude sharing. Your motor vehicle liability insurance may exclude coverage for a shared vehicle.
(g) Roadside assistance and help line. For roadside assistance, accidents and other customer service, call Ridez on (954) 676-8128. The line is answered from 11:00 a.m. to 11:00 p.m. Eastern time, every day. Outside those hours, for an accident or injury call 911 first, then report it to Ridez when the line opens.
(h) Guest insurance. A guest is not required to have their own personal insurance to book a trip on Ridez.
3. Your cars and listings
Every car you list must have a current registration and plates, the insurance section 15.1 requires, no unrepaired safety recall (section 3A), and must be roadworthy and maintained to the manufacturer’s schedule. Renew plates before the date on the registration, and keep insurance in force for every day the car is shared.
Keep each listing accurate. You are responsible for scheduled maintenance and for mechanical failure that a guest did not cause. On trips of 30 days or more, the guest must bring the car in for scheduled maintenance when asked.
3A. Safety recalls
Statutory notice: Fla. Stat. § 627.7483(6)(d).
Before your car is listed, Ridez checks it by VIN for open safety recalls, and will not list a car with an unrepaired recall.
(a) If you have received actual notice of a safety recall on your car, you may not list it until the recall repair has been made.
(b) If you receive actual notice of a safety recall while the car is listed, you must take it off Ridez as soon as practicably possible and keep it off until the repair has been made.
(c) If you receive actual notice of a safety recall while a guest has the car, you must tell Ridez as soon as practicably possible so the repair can be addressed.
Cancelling a trip for a recall never carries the host cancellation fee.
4. Your price
Your daily rate. You set a daily rate on each car. For each day the guest has the car, up to the days they paid for, you are paid that rate. If you set different rates for different days, a trip pays the average of your rates on the days it was booked for. Guests pay Ridez’s fees on top. You may change your rate whenever you like.
Discounts and extras. On a trip booked for 7 days or more, every 7th day is free for the guest and is not paid to you, so a week pays 6 days. Any long-trip discount you set comes off your rate when the trip is booked for at least the days you chose for it, even if the car comes back early. Up to half of any early-booking discount the guest got comes off too, less if the car comes back early. Extras the guest booked with the car, such as a child seat or delivery, are added.
Last-minute bookings. When a guest books at short notice, they pay Ridez a last-minute surcharge. Ridez keeps all of it, and none of it is paid to you. The one exception is a trip open on the evening of 4 October 2026, where it counts in the trip price you receive half of (section 6(d)).
Plan fee. The plan fee for the plan you chose for the car (section 22A) comes off your pay for each trip the plan applies to.
5. When you earn it
You earn your pay as the guest pays, so a trip half paid is half earned. Your pay is never more than the guest is charged for the trip before tax, less the last-minute surcharge; on a trip under section 6(d), your pay is never more than half of the trip price defined there. Anything the guest pays with Ridez credit is paid out to you only as section 6(c) sets out.
6. Your share on other kinds of trips
(a) Commission. If a car had no daily rate when its trip was booked (an older or imported trip, or a car you added without one), Ridez takes a commission on that trip instead. The percentage is the one recorded on that trip when it was booked or, if the trip recorded none, your commission percentage when it is paid out, as shown in your account. It is taken on everything the guest pays on that trip before tax except the price of the guest’s protection plan (Minimum, Standard or Maximum), which is Ridez’s alone and is never shared with you. That means the trip days, extras and fees, including fees Ridez adds to the trip, such as a returned-payment or vehicle exchange fee. It is not taken on the last-minute surcharge, which Ridez keeps whole, or on a cost paid back to you. The rest is yours.
(b) Holding company share. This applies only where your account carries a holding company share. On those trips, a further share of the same amount goes to the company that holds the cars: the share recorded on the trip or, if it recorded none, the share on your account when it is paid out.
(c) Trips paid with Ridez credit. When a guest pays for part of a trip with promotional credit, you are paid as if the guest had paid that part in money. Credit that came from the guest’s own earlier payment earns you nothing, because that money was already paid out on the earlier trip; you earn only on the rest, so if a guest pays half a trip with that kind of credit, you earn half your pay for that trip. Both rules are the same on every kind of trip: one paid at your daily rate, one Ridez takes a commission on, one open on the evening of 4 October 2026, and one with pay set by hand. Two things are still paid: when Ridez turns a security deposit the guest paid in money into credit, that part is paid out on that trip (section 13), and costs paid back to you are paid in full (section 8).
(d) Trips open on the evening of 4 October 2026. A trip that was booked, out, or back but not yet closed when this rule took effect, on the evening of 4 October 2026, pays you half of the trip price instead of your daily rate or a commission, even if the car had no daily rate. By accepting this agreement, you agree that this rule applies to those trips. The trip price is everything the guest is charged for the trip before tax: the trip days less any discount, protection, fees charged at booking, any last-minute surcharge, and extras the guest booked with the car. Tax is never part of the split: Ridez collects and pays all Florida sales tax, any county surtax, the car-sharing surcharge and any other government tax or surcharge on the trip (section 7), and none of it is counted in the trip price. The trip price does not include tolls, fuel, cleaning or other charges Ridez adds to the trip after booking, a goodwill credit Ridez gives the guest, or the security deposit. You earn it as the guest pays, and it is never more than the limit in section 5. A trip booked without a daily price for the guest keeps the pay set out in section 4 or section 6(a). The Host Protection Plan and its plan fee do not apply to these trips.
(e) Pay set by hand. Ridez may set your pay on a single trip by hand, with the reason written on the trip. That amount replaces your pay for that trip under section 4, or half the trip price on a trip under section 6(d). You still earn it as the guest pays, and it is never more than the limit in section 5. Pay is never set by hand on a trip Ridez takes a commission on. Costs paid back to you, and what comes off your payout, still apply.
7. Taxes
Ridez collects and pays Florida sales tax, any county surtax and the peer-to-peer car-sharing surcharge on each trip. You are responsible for tax on your own income from your cars. Ridez sends you the tax forms the law requires.
8. Payouts
Costs paid back to you. When you ask to be paid back for a cost, such as fuel, tolls or cleaning, and Ridez charges the guest for it, you get the full amount and no commission or plan fee is taken on it.
Loss of Use collected from a guest. When Ridez actually collects a Loss of Use charge from a guest under the guest agreement, it is paid to you as a cost paid back, in full and with no commission or plan fee.
What comes off your payout. If Ridez pays a toll, ticket, impound, fuel, charging or cleaning cost on your car and does not charge it to a guest, it comes off your payout. Cash you take from a guest yourself, other than a deposit, is already in your hands, so it comes off your payout too. The plan fee comes off the payout for each trip (section 22A), and your Host Protection Plan deductible comes off your payouts the same way (section 23). If what comes off is more than a payout, the rest comes off the next one.
When you are paid. A trip is payable 3 days after the car is back. Payouts go out every second Friday and cover everything that is payable by the Wednesday before.
9. Guests and who may drive
No one under 19 may drive. Premium cars require a driver aged 21 or over with a full licence. Learner’s permits are accepted on Lowkey and Standard cars only. Temporary paper licences are not accepted. Every driver must hold a valid licence and be present with photo ID at pickup or delivery. Florida licences are checked against the state’s driver database.
Ridez checks each guest’s licence in the app before handoff. At handoff, you confirm in person that the face of the person in front of you matches the licence.
10. Trip rules
Under the guest agreement, a guest may not: let anyone who is not an authorised driver drive the car; carry people or goods for pay, unless Ridez has approved rideshare or delivery use in writing; race, drive off-road, push or tow anything; drive impaired; use the car in a crime; drive at 100 mph or more; or leave the United States. The car must stay inside Miami-Dade, Broward and Palm Beach Counties unless travel further out is approved and paid for in advance. Cars carry GPS and telematics, and the guest agrees to that monitoring.
You may not hand over or take back a car at an airport except at a location and under the terms Ridez has arranged with that airport.
10A. Monitoring equipment
Ridez is solely responsible for any equipment Ridez puts in or on your car to monitor or facilitate trips, including GPS devices, and will indemnify you for damage to or theft of that equipment during a car-sharing period that you did not cause. A tracking device you install yourself stays yours and your responsibility.
11. Cancellations by guests
Once a trip is booked, nothing the guest has paid toward it is refunded in cash. The reservation fee becomes credit toward a future trip. If the booked car becomes unavailable, the guest is offered a car of the same class at the same rate, a move to another booking, or credit. Any part of a trip paid with credit is paid out to you only as section 6(c) sets out.
12. Cancellations by hosts
You may cancel a booked trip only when the car is unsafe or unavailable. Ridez then offers the guest a car of the same class. Because Ridez’s cost of rebooking the guest, compensating them and losing the trip is hard to measure in advance, you pay Ridez $150 for each trip you cancel, as a reasonable estimate of that cost and not as a penalty. No fee is charged when you cancel because of a safety recall, a crash or theft not caused by you, or damage from the previous trip, if you tell Ridez as soon as you know.
13. Security deposits
Ridez sets the security deposit for each trip by the car’s group alone. Neither the protection plan the guest picks (Minimum, Standard or Maximum) nor the Host Protection Plan you choose changes it. You do not set it.
| Car group | Day price | Security deposit |
|---|---|---|
| Lowkey | Under $100 | $150 |
| Standard | $100 to $199 | $250 |
| Premium | $200 or more | $500 |
A security deposit returned to the guest is never yours, and no commission is taken on it. If Ridez uses part of a deposit the guest paid in money to pay what the guest owes on the trip, or turns it into credit for the guest, that part is paid out on that trip like any other payment the guest makes. Any part of a deposit the guest paid with Ridez credit is treated as section 6(c) sets out. Any part of a deposit Ridez holds back for damage is applied as section 31 sets out.
14. Damage, accidents and claims
The pickup and return Trip Photos are the record of each car’s condition. A guest is charged only for damage that is not in the pickup photos. Guests must tell Ridez about an accident straight away on (954) 676-8128, get a police report, and send photos and the other driver’s details; outside support hours, they call 911 first for an accident or injury and report it to Ridez when the line opens. Theft and vandalism are reported to Ridez straight away. When new damage is found, the guest’s deposit is held until a repair estimate is ready.
Physical damage to your car during a trip is reimbursed under Part 2, the Host Protection Plan, on the terms of the plan you chose for that car. You must report damage, in the app or by phone during support hours, within 24 hours after the car is back.
The guest’s cap. Each guest picks a protection plan (Minimum, Standard or Maximum) before booking, or chooses to rely on their own insurance; no guest has to have their own insurance to book (section 2A(h)). The guest’s protection plan caps what the guest owes for cosmetic damage only, as “Cosmetic damage” is defined in section 1: up to $3,000 on Minimum, up to $500 on Standard, and $0 on Maximum. Mechanical and all other damage is the guest’s at full cost, with no cap. You agree that the plan the guest picked limits what you, as Shared Vehicle Owner, may collect from that guest for cosmetic damage, and that Ridez may give that limit on your behalf. The cap does not limit what may be collected from the guest for damage that is not cosmetic damage. Once Ridez pays a claim on your car, your right to collect from the guest for that damage passes to Ridez, and what Ridez recovers is shared as section 31 sets out: it repays your deductible first, then Ridez, and anything left over is paid to you.
When the guest’s cap stops collection. Where the guest’s cap stops Ridez collecting cosmetic damage from the guest, Ridez reimburses you for that cosmetic damage under the Host Protection Plan with no deductible, up to $1,500 per trip. Any such cosmetic damage above $1,500 on that trip is reimbursed under the Host Protection Plan with your plan deductible applying (section 23).
14A. Trip records
Ridez collects and verifies, for every trip, the times used, pickup and return locations, and what you earned, and each guest’s and additional driver’s name, address, licence number and place of issue. Ridez keeps these records for at least the personal injury limitation period under Florida law, and gives them on request to you, your insurer or the guest’s insurer for a claim investigation, settlement, negotiation or litigation.
15. Insurance and liability
15.1 Your own policy. For every car you list you must keep, at your own cost, an auto insurance policy that:
(a) is a commercial auto policy, or a policy with an endorsement that expressly covers sharing the car through a peer-to-peer car-sharing program such as Ridez;
(b) carries at least the Florida minimums, or more: bodily injury liability of $10,000 per person and $20,000 per crash (§ 324.021(7)(a)–(b)); property damage liability of $10,000 (§ 324.022); personal injury protection of $10,000 (§ 627.736); and uninsured/underinsured motorist coverage as required by § 627.727;
(c) names you;
(d) insures every authorized guest driver while driving the car during a car-sharing period; and
(e) is in force for every day the car is listed or on a trip.
Keeping it in force, and proof. You promise to keep this policy in force, without a lapse, for every day the car is listed or on a trip. You must tell Ridez within 24 hours if the policy lapses, is cancelled, or changes so that it no longer meets this section, or if your insurer tells you it excludes trips through Ridez. Ridez checks proof of the policy before the car is listed, and again at every renewal of the policy. A car is taken off the platform, and cannot be booked, from the day the policy lapses or expires until Ridez has checked proof of the renewal or of a replacement policy.
A personal auto policy without a car-sharing endorsement does not meet this section. Ask your own insurer what your policy covers before you list. Ridez gives no advice about your policy and cannot tell you what it covers.
15.2 Liability during a trip until the Switch Date. Ridez holds no liability insurance policy for trips on the date of this version, and under this agreement Ridez does not itself promise to pay for injury to other people or damage to their property. Until the Switch Date, your policy under 15.1 is the primary insurance for that liability during a trip on your car. The Host Protection Plan in Part 2 never pays for it.
15.3 What Florida law requires of Ridez. Nothing in this agreement reduces any duty Florida law places on Ridez, and Ridez’s duties do not remove yours.
(a) As Fla. Stat. § 627.7483(3)(a) requires, Ridez assumes your liability as shared vehicle owner for bodily injury or property damage to third parties, and for uninsured/underinsured motorist and personal injury protection losses, during each car-sharing period, in the minimum amounts listed in 15.1(b), which are the amounts this agreement states for that purpose. This assumption does not apply if you (i) make an intentional or fraudulent material misrepresentation or omission to Ridez before the car-sharing period in which the loss occurs, or (ii) act in concert with a guest who fails to return the car as the guest agreement requires.
(b) Fla. Stat. § 627.7483(2) requires that, where your policy has lapsed or does not provide the required coverage for the trip, Ridez provides it from the first dollar of a claim and defends the claim, without waiting for any other insurer to deny it. If Ridez pays anything because your policy lapsed, was cancelled or excluded the trip, Ridez may recover that amount from you as economic loss caused by your breach (section 15A and the notice in section 2A(b)).
15.4 Listing before Ridez’s policy is bound. Until the Switch Date, a car may be listed and booked on Ridez once Ridez has checked proof of your policy under 15.1, even though Ridez has not yet obtained a Platform Liability Policy.
15.5 Order of insurance. During the car-sharing period, the insurance that meets Fla. Stat. § 627.7483(2)(a) is primary. Until the Switch Date that is your policy under 15.1. From the Switch Date it is as 15.6 sets out. Nothing in this agreement or the guest agreement makes any duty Florida law places on Ridez depend on your policy or the guest’s policy paying or denying first. Between you and Ridez only, Ridez may recover from you an amount Ridez paid because of your breach of this agreement (section 15A).
15.6 The switch to the Platform Liability Policy. The switch is automatic. From the Switch Date, with no new signature and nothing further from you:
(a) injury to other people, and damage to their property, caused during a trip on your car is insured under the Platform Liability Policy, for the people it names, up to the limits it states for each accident (injury and property damage together), and never below the minimums in 15.1(b) or a higher amount a state law or an airport requires;
(b) that policy is the primary insurance for that liability during the car-sharing period, and it is the insurance Ridez maintains under Fla. Stat. § 627.7483(2); your policy under 15.1 then applies only as the Switch Notice states;
(c) personal injury protection and uninsured or underinsured motorist cover under it are included only at the minimum the law requires, and only where the law does not let them be waived; and
(d) claims under it are handled by the insurer or the claims company it names, not by Ridez.
Ridez sends you a Switch Notice in writing within 10 days after the Switch Date, naming the insurer, the Switch Date and the limits. The switch does not wait for the notice. Your duties under 15.1 continue after the Switch Date unless a Switch Notice reduces them; a Switch Notice may reduce or remove your duties under 15.1 but may not add to them. If a Platform Liability Policy ends and is not replaced the same day, Ridez tells you in writing straight away, and 15.2 applies again from the day it ended.
15.7 Above the limits. Florida law (Fla. Stat. § 627.7483(3)(b)) exempts you from liability that is imposed only because you own the car. You remain responsible for your own acts, such as failing to maintain the car or to repair a safety recall, and for amounts above any policy’s limits that arise from them. Ask your own insurer or lawyer about your situation.
The Host Protection Plan is not insurance and does not replace your policy.
15A. Your indemnity
You will indemnify Ridez for economic loss Ridez suffers because you breached this agreement, including by listing a car without the insurance section 15.1 requires, letting that policy lapse or not telling Ridez of a lapse, misrepresenting a car or its condition, or failing to maintain a car or repair a safety recall. This does not cover loss caused by Ridez’s own negligence. Ridez may set off amounts you owe under this section against your payouts (section 8).
16. What hosts may not do
- List a car with an unrepaired safety recall (section 3A).
- List a car without the insurance section 15.1 requires.
- List the same car on another platform for the same dates.
- Take a booking from a Ridez guest outside the app.
- Keep a listing that is not accurate.
17. Suspension and ending this agreement
You may take any car off the platform at any time (section 2). Either you or Ridez may end this agreement by giving 30 days’ written notice. Trips already booked and claims already open finish under these terms. Ridez may suspend your account at once for safety or fraud.
18. Limits on liability
(a) Except as stated in (b), the most Ridez owes you under this agreement for all claims in total is the fees Ridez earned from trips on your cars in the 12 months before the claim arose. Neither party is liable to the other for lost profits or other indirect or consequential loss, except loss of use paid under section 8.
(b) Section (a) does not limit: any duty Florida law places on Ridez, including under Fla. Stat. § 627.7483 (section 15.3); Ridez’s duty under section 10A for monitoring equipment; payouts you have earned; amounts payable under the Host Protection Plan; or liability for fraud, intentional misconduct or gross negligence.
19. Disputes and governing law
(a) Florida law. This agreement is governed by the laws of the State of Florida. The Federal Arbitration Act governs this section.
(b) Talk first. Before either party starts a claim, it writes to the other describing the dispute and what it wants. Notice to Ridez goes to support@ridezrentals.com; notice to you goes to the email in your account. The parties then have 30 days to try to resolve it.
(c) Binding individual arbitration. Any dispute between you and Ridez that is not settled in those 30 days is decided by binding arbitration, not in court. That includes disputes about this agreement, Part 2, your listings, trips on your cars and your payouts. One arbitrator decides it, administered by the American Arbitration Association under its Consumer Arbitration Rules. The hearing takes place in Broward County, Florida, or by phone or video. The arbitrator’s award is final, and any court with jurisdiction may enter judgment on it.
(d) No class actions and no jury. Each party brings claims only for itself, never as a plaintiff or class member in a class, collective or representative action, and the arbitrator may not combine different people’s claims. You and Ridez each waive the right to a jury trial.
(e) Small claims. Either party may bring a claim in small claims court instead, as long as it qualifies there and stays an individual claim.
(f) Opting out. You may opt out of this section within 30 days after you first accept a version of this agreement that contains it, by emailing support@ridezrentals.com from the email in your account and saying you opt out of arbitration. If you opt out, disputes are decided by the courts located in Broward County, Florida, and each party agrees to those courts. Opting out changes nothing else in this agreement.
(g) If (d) cannot be enforced for a claim, that claim is decided by the courts located in Broward County, Florida, and not in arbitration.
20. Changes and assignment
When the wording of this agreement changes, including any plan fee or deductible in Part 2, Ridez emails you the new version and posts it on Ridez at least 30 days before it takes effect. A change made for safety or to meet the law may take effect sooner if the law requires it. You accept the new version the same way you accepted this one: by keeping your host account and continuing to list on Ridez after the date it takes effect. You are not asked to sign again. Ridez records the version and the date. If you do not agree to the new version, you may end this agreement by giving notice under section 17 before the date it takes effect. If you do, the old version keeps applying to you until your agreement ends, and trips already booked finish on the old terms. The switch under 15.6 takes effect on the Switch Date without a new signature.
Ridez may assign its rights and duties under the Host Protection Plan to a Ridez affiliate it names to you in writing, and a claim from a trip that started before the date of that notice stays with Ridez unless the notice says otherwise. If Ridez assigns the Host Protection Plan to an affiliate, Ridez remains responsible to you for every claim the affiliate does not pay when due.
20A. General
(a) If any part of this agreement is unenforceable, the rest stays in force, and the unenforceable part is read as the nearest enforceable term.
(b) Sections 8, 14A, 15.3 and 15.6 (for car-sharing periods that started before the end), 15A, 18, 19 and Part 2 (for damage during trips that started before the end) survive the end of this agreement.
(c) Between you and Ridez, this agreement prevails over the guest agreement where they conflict.
(d) You are an independent business; nothing here makes you Ridez’s employee, agent or partner.
(e) Notices go to the email in your account or to support@ridezrentals.com and take effect when sent.
(f) You agree to sign electronically.
(g) You promise that you own each car or are authorized by its registered owner to share it, that its registration is current, and that sharing it does not breach any lien or lease, or that you have the lienholder’s or lessor’s consent.
Part 2 — Host Protection Plan
21. What this plan is
The Host Protection Plan is Ridez’s own contractual promise to you, under this agreement, to reimburse physical damage to your car during a trip. It is not an insurance policy, Ridez is not an insurer, and no insurance company stands behind the plan. Ridez makes this promise because it arranges the trip and holds the guest’s obligations for the damage.
The plan reimburses physical damage to your own car during the car-sharing period of a trip booked on Ridez, and nothing else. It never pays for injury to anyone or for damage to anyone else’s property, and it gives no liability, medical, personal injury protection or uninsured motorist benefits of any kind; liability to other people is dealt with under section 15, by insurance, never by this plan. It does not replace your own policy under section 15.1, and it does not meet a lienholder’s or lessor’s requirement for physical damage insurance. Ridez makes the decision on each claim under this plan.
22A. Plans, plan fees and deductibles
You choose one plan for each car when you list it. The plan sets two things: the plan fee, which is the share of your pay on each trip that Ridez keeps for the plan, and your deductible, which is the part of each eligible claim you pay. A lower deductible has a higher plan fee, and on the same plan a car worth more has a higher deductible.
| Plan | Plan fee (share of your pay) | You keep | Deductible, car worth under $45,000 | Deductible, car worth $45,000 to $75,000 | Deductible, car worth over $75,000 to $100,000 |
|---|---|---|---|---|---|
| Plan 100 | 0% | 100% | $1,500 | $3,000 | $5,000 |
| Plan 90 | 10% | 90% | $750 | $1,500 | $2,500 |
| Plan 80 | 20% | 80% | $250 | $500 | $750 |
| Plan 75 | 25% | 75% | $0 | $0 | $0 |
Your car’s value. The deductible column is set by the car’s actual cash value (section 25) when the trip was booked. For a car worth more than $100,000, Ridez tells you in writing, before you list it, the deductible for each plan.
How the plan fee is taken. The plan fee is a percentage of your pay for the trip under section 4, 6(a), 6(c) or 6(e), after any commission or holding company share. It comes off the payout for that trip. It is never taken on costs paid back to you, on Loss of Use paid to you (section 8), or on trips under section 6(d).
Which plan applies. A trip is under the plan the car had when the trip was booked. If you do not choose, the car is on Plan 100. You may change a car’s plan at any time in your account; the change applies to trips booked after it. The plan fees and deductibles change only through a new version of this agreement that you accept under section 20.
22. What Ridez reimburses
Damage. If your car suffers sudden, accidental physical damage during the car-sharing period of a trip booked through Ridez, whoever or whatever causes it (including a guest, another driver, vandalism or weather), Ridez arranges and pays for the repair, and you pay only your plan’s deductible. The repair bill goes to Ridez, not to you.
Vandalism. Vandalism during a trip is eligible damage like any other, once a police report has been filed.
Theft. If your car is stolen during a trip and is not found within 30 days, it is treated as a total loss and reimbursed under section 25. A police report must be filed and your own insurer must be told first.
How Ridez reimburses. Ridez reimburses eligible damage either as the reasonable cost of the repair or as the car’s actual cash value (section 25), whichever Ridez chooses, minus your plan’s deductible.
Limit. The most Ridez reimburses on one claim is the lower of the car’s actual cash value and $200,000.
If your own insurer also pays. Ridez reimburses without first requiring you to claim on your own policy. If your own insurer pays for the same damage, Ridez’s payment is reduced by what your insurer paid, and you must tell Ridez of any such payment.
23. Your deductible
Your deductible is the one in section 22A for the plan the car had and the car’s value when the trip was booked, per claim, on every car group (Lowkey, Standard and Premium). It applies to every kind of eligible damage: the body, the interior, tires, glass and mechanical damage. It is the only part of an eligible repair that you pay. It does not apply to the first $1,500 per trip of cosmetic damage Ridez reimburses under section 14 because the guest’s cap stopped Ridez collecting it; it does apply to such cosmetic damage above $1,500 on that trip. Ridez takes it off your next payouts, and anything left over comes off the payout after that (section 8). What Ridez recovers from the guest repays your deductible first (section 31).
24. How repairs are done
Ridez arranges repair of eligible damage through certified body shops in the Ridez body shop network. Ridez pays the shop for everything above your deductible.
25. When a car is a total loss
If the car cannot be repaired, Ridez reimburses you the car’s actual cash value minus your plan’s deductible, up to the limit in section 22.
Actual cash value is what your car was worth just before the loss. It is worked out from the car’s year, make, model, mileage and condition before the loss, compared with similar cars for sale in your local market, and set by an industry valuation tool applied to those facts, namely J.D. Power (NADA Guides). Actual cash value includes the sales tax and title fees to buy a comparable car.
If you dispute the value, you may obtain an appraisal from an independent licensed appraiser at your cost; if it differs from Ridez’s value by more than 10%, the two appraisers choose a third, whose figure binds both parties, and Ridez pays the third appraiser.
The title or the salvage value. On a total loss, one of two things happens, as chosen by Ridez:
(a) You sign the car’s title over to Ridez and, if asked, deliver the car where Ridez says. Ridez pays you the actual cash value minus your deductible.
(b) You keep the car. Ridez pays you the actual cash value minus your deductible and minus the car’s salvage value. The salvage value is the highest quote for the damaged car from an outside salvage buyer.
Liens. Where the car has a lien, Ridez pays the lienholder first, up to the payoff amount, and pays you the rest.
A stolen car that is found. If a stolen car is recovered after Ridez has paid, it belongs to Ridez; if it is recovered before payment, it is treated as damage under section 22.
Ridez pays within 30 days after the value is agreed and, under (a), the title and keys have been handed over.
26. Loss of use is not reimbursed
The plan does not pay for the days your car cannot be booked while it is damaged or in repair, or for income lost during that time. If Ridez actually collects a Loss of Use charge from the guest under the guest agreement, that money is paid to you as a cost paid back (section 8).
27. What the plan does not reimburse
(a) Amounts the plan does not pay.
- Loss of use and lost income (section 26).
- Diminished value: the drop in what the car is worth because it was damaged or repaired, even after a good repair.
- The quality of a repair: if a repair done by a Ridez network shop is defective, Ridez will have it corrected at no cost to you if you report the defect within 90 days of getting the car back. Ridez does not pay for damage that was not part of the claim.
- Storage fees above a reasonable amount: Ridez pays storage only at a reasonable rate for the local market, up to $2,500. You must keep these costs down and move the car out of paid storage promptly once asked or once the car can be moved. Ridez tells you in writing before it applies this limit.
- Charges above the agreed amount: any repair or other charge above the amount Ridez agreed to pay is yours.
- High-value cars without location information: if the car is worth $125,000 or more and has no working tracking device of your own (section 10A), or you do not give the car’s location information when asked, Ridez holds back 20% of what it would otherwise pay. Ridez tells you in writing before it applies this hold-back.
(b) Events outside the plan.
- Normal wear and tear.
- Damage that happens outside the car-sharing period of a trip booked on Ridez, including personal use and use on another platform.
- Damage that shows in the pickup Trip Photos, meaning it was there before the trip.
- Mechanical failure not caused by something that happened during the trip. This is your responsibility (section 3).
- Tire and glass damage, unless it happened during the trip and the Trip Photos show it.
- Loss or damage caused by a dishonest, fraudulent, reckless, criminal or malicious act by you or anyone acting for you.
- Losses that follow from the damage rather than the damage itself, such as missed bookings or other business losses.
- Injury to anyone, and damage to anyone else’s property. That is liability, dealt with under section 15, never under this plan.
28. How to make a claim
- Tell Ridez in the app, or on (954) 676-8128 during support hours, within 24 hours after the car is back.
- Make sure the pickup and return Trip Photos show the damaged area.
- For an accident, include the police report or report number, the other driver’s details and the scene photos the guest was required to collect.
- For theft or vandalism, include the police report. For theft, also confirm that you have told your own insurer.
- Do not have the car repaired before Ridez decides the claim. Ridez arranges repair through its network (section 24).
29. Evidence needed
A claim needs the pickup and return Trip Photos of the damaged area, the police report where there is one, any information the guest supplied about the accident, and the repair estimate from the body shop.
Photo windows. Pickup Trip Photos must be taken no more than 24 hours before the trip starts and uploaded no later than 24 hours after it starts. Return Trip Photos must be uploaded within 24 hours after the trip ends.
Where the photos fall short, other evidence, such as a police report, may be weighed. A claim is not refused only because the car was impounded or you could not get it back to photograph it.
30. Timelines
| Step | Time |
|---|---|
| You report damage | Within 24 hours after the car is back |
| You upload Trip Photos | Within the windows in section 29 |
| Ridez tells you what it still needs | Within 5 business days after your report |
| The guest’s deposit is held | Until the repair estimate is ready |
| Ridez decides the claim | Within 30 business days after the claim is complete |
| Ridez pays a total loss | Within the days in section 25, after the value is agreed and the title and keys have been handed over |
A late report is refused only to the extent the delay stopped Ridez from assessing the damage or recovering from the guest. Ridez tells you within 5 business days after your report what it still needs; the claim is complete when you have provided it.
31. What Ridez pays, and how recoveries are shared
Ridez pays the body shop directly for each eligible repair, minus your deductible. On a total loss it pays you the actual cash value minus your deductible. Anything recovered from the guest or the guest’s insurer for that damage, including any part of the deposit held back for it, is applied first to repay you your deductible and any eligible cost you paid, then to Ridez up to what Ridez paid. Ridez pays any remainder to you. Ridez applies recoveries within 10 business days after it receives them.
