Guest car-sharing agreement

GUEST CAR-SHARING AGREEMENT

Version 3.13 · Effective October 20, 2026 · Supersedes all prior versions

THIS AGREEMENT is between the vehicle owner named above (the "Shared Vehicle Owner" or "Owner," "we," "us," or "our"), who owns the vehicle described in the Rental Summary, and the person identified as the Guest in the Rental Summary ("you" or "Guest"). You book and pay for this trip through the Ridez platform, which is operated by Ridez Marketplace LLC, a Wyoming limited liability company ("Ridez"), the platform operator.

The Rental Summary (showing the vehicle, dates, rates, deposit, and charges), this document, and the Fee Schedule in Section 20 together form the "Agreement." Where a Fees and Rules page accompanies this Agreement, it sums up the Agreement for convenience only; if it ever differs from the Agreement, the Agreement controls.

This is car sharing, not a rental. The Owner owns the vehicle and shares it with you through Ridez, a peer-to-peer car-sharing program. Ridez operates the platform through which it is booked and paid for, and does not own the vehicle.

1. DEFINITIONS

"Vehicle" — the automobile identified in the Rental Summary and any vehicle we substitute for it, including its tires, tools, accessories, equipment, keys, transponder, and documents.

"Authorized Driver" — you, and each additional driver we have listed on this Agreement, provided each such person (a) holds a valid, unexpired driver's license, (b) meets the age requirements in Section 3, and (c) was physically present with photo identification when this Agreement was signed. No one else may operate the Vehicle under any circumstances.

"Rental Period" — the car-sharing period: from the time you take possession of the Vehicle until it is returned to us or recovered by us, and in either case checked in by us.

"Security Deposit" — the refundable sum, in cash or as a hold on your saved card, described in Section 8.

"Reservation Fee" — the non-refundable sum described in Section 9.

"Service Area" — Miami-Dade County, Broward County, and Palm Beach County, Florida.

"Trip Photos" — the photographs of the Vehicle we take at the start and end of the Rental Period, which are the record of the Vehicle's condition.

"Loss of Use" — our loss of the ability to use the Vehicle for any purpose while it is damaged, being repaired, or missing, calculated as 100% of the daily rental rate for each day from the date of damage or loss until the Vehicle is repaired or replaced. You and we agree this is a reasonable estimate of actual damages and not a penalty.

"Diminished Value" — the Vehicle's actual cash value immediately before damage, less its value after repair.

2. CAR SHARING AND CONDITION

You are using the Vehicle through car sharing, not buying it. Title remains with the Owner at all times.

You acknowledge that you received the Vehicle in good physical and mechanical condition, except for any condition shown in the Trip Photos, and that you had an adequate opportunity to inspect it. The Trip Photos taken at the start of the Rental Period are the agreed record of the Vehicle's condition, and any damage not visible in them is presumed to have occurred during the Rental Period.

We make no warranties, express or implied, regarding the Vehicle, including any warranty of merchantability or fitness for a particular purpose.

If you believe the Vehicle is unsafe, stop driving it immediately and contact Ridez at (954) 676-8128.

You may not alter, modify, or tamper with the Vehicle, its odometer, its telematics equipment, or any transponder.

3. WHO MAY DRIVE

Minimum age: 19. No one under 19 may book or drive the Vehicle under any circumstances.

Vehicle classMinimum ageLicense required
Lowkey19Valid license or learner's permit
Standard19Valid license or learner's permit
Premium21Valid full license only

Every Authorized Driver must hold a valid, unexpired license and be physically present with photo identification at pickup or at delivery handoff. We verify each Florida license against the Florida Highway Safety and Motor Vehicles database and compare the license photograph to the person present.

Learner's permits are accepted on Lowkey and Standard vehicles only.

Out-of-state and international licenses are accepted if valid and unexpired. Temporary paper licenses are not accepted.

If your license is suspended or expired, you may book only if a person aged 21 or over holding a valid license (a) signs this Agreement as the Guest, (b) is physically present with identification, and (c) is the person who operates the Vehicle. A person whose license is suspended or expired may not operate the Vehicle at any time, and doing so is a material breach of this Agreement.

Additional drivers may be added at no charge, subject to the same requirements.

Permitting anyone who is not an Authorized Driver to operate the Vehicle is a material breach, voids any coverage the Owner or you provide, except the minimum liability coverage Florida law requires of Ridez, and makes you responsible for all resulting loss.

4. USE OF THE VEHICLE

You agree that the Vehicle will not be:

(a) operated by anyone other than an Authorized Driver; (b) used to carry persons or property for hire, except that use for a rideshare or delivery platform is permitted where we have approved it in writing in the Rental Summary; (c) used in any speed contest, race, or off-road driving; (d) used to push or tow anything; (e) operated by anyone under the influence of alcohol, any illegal drug, or any substance that impairs driving; (f) used in the commission of any crime; (g) operated outside the Service Area without our prior approval and payment of the applicable travel fee under Section 6; (h) operated outside the United States; (i) operated at speeds of 100 miles per hour or more.

Telematics. The Vehicle is equipped with GPS and telematics equipment that records its location, speed, and operating status. You consent to this monitoring for the duration of the Rental Period.

5. MILEAGE

ClassIncluded mileageEach additional mile
LowkeyUnlimited (within the Service Area — see Section 6)—
Standard200 miles per day$0.25
Premium150 miles per day$0.50

For trips of more than one day, the included mileage is the daily allowance multiplied by the number of trip days, pooled across the Rental Period. Additional mileage may be purchased in advance at a rate we quote.

"Unlimited mileage" on Lowkey vehicles means unlimited distance within the Service Area. It does not permit travel outside the Service Area.

6. WHERE YOU MAY DRIVE

The Vehicle must remain within the Service Area — Miami-Dade, Broward, and Palm Beach Counties — unless we approve travel in advance and you pay the applicable fee before the Vehicle leaves:

DestinationFee, per Rental Period
Tampa · Orlando · Naples$250
Tallahassee · Jacksonville$500
Any destination outside Florida$750
Mexico · Canada · outside the United StatesNot permitted

Taking the Vehicle outside the Service Area without our prior approval is a material breach of this Agreement and results in forfeiture of the Security Deposit under Section 8, in addition to the applicable travel fee and any other amounts you owe.

We monitor Vehicle location. If the Vehicle leaves the Service Area without an approved travel fee, we will contact you and you will have one hour to pay the fee before we exercise our rights under Section 13.

7. CHARGES

You agree to pay all amounts shown on the Rental Summary and all additional charges under this Agreement, including:

(a) the daily rental rate for each day of the Rental Period; (b) all applicable taxes and surcharges; (c) a 4% processing fee on payments made by credit or debit card; (d) mileage charges under Section 5; (e) toll charges under Section 11; (f) fuel and charging shortfalls under Section 12; (g) late return charges under Section 10; (h) all administrative and condition-related fees in the Fee Schedule at Section 20; (i) all costs we incur recovering the Vehicle if it is not returned as agreed; (j) all costs of collection, including pre- and post-judgment attorney's fees; (k) a late payment charge of 2% per month, or the maximum permitted by law, on amounts unpaid after the Rental Period ends; (l) $50, or the maximum permitted by law, for any payment returned unpaid.

All charges are subject to our final audit. If an error in computation is discovered after the transaction closes, you authorize us to correct it.

Payment methods. We accept credit and debit cards, cash, Zelle, Apple Pay, Chime, CashApp, and card payment links. A payment is not received until funds are confirmed by us. A payment confirmation, screenshot, or receipt from your own application is not proof of payment, and we are not obligated to release the Vehicle, restore a disabled Vehicle, or release the Security Deposit until funds are confirmed.

Card on file. When you book, you give us a credit or debit card. You authorize us and Ridez, through our payment processor, to save that card and any card you add later, and to charge any saved card without asking you again for any amount you owe under this Agreement, including rental charges, extensions, taxes, tolls, tickets and traffic violations, fuel or charging shortfalls, mileage, cleaning and smoking fees, damage, Loss of Use, Diminished Value, and the fees in Section 20. You also authorize a hold on a saved card for the Security Deposit. If a charge is declined, you authorize us to try it again and to charge any other saved card. Before we charge a saved card for damage, we send you an itemized notice with the Trip Photos and the repair estimate, and we do not charge it sooner than 48 hours after that notice. This authorization lasts until everything you owe under this Agreement is paid. A dispute with your card issuer does not cancel what you owe.

Payments are confirmed during business hours only (11:00 AM – 11:00 PM Eastern). Payments submitted outside those hours are confirmed the following business day.

Submitting a falsified or altered payment confirmation is a material breach, incurs the administrative fee in Section 20, and permits us to terminate this Agreement immediately.

8. SECURITY DEPOSIT

You will pay a refundable Security Deposit in cash or as a hold on your saved card in the amount shown on the Rental Summary. When you book through the Ridez platform, it is set by the Vehicle's price group, which is also the Vehicle's class in Sections 3 and 5. The price group follows the Vehicle's daily price on the Ridez platform for your trip dates, with the Minimum protection plan included and before taxes. When those dates carry different daily prices, including a holiday or other date-specific price, the price group follows their average. The deposit is the same whichever protection plan you choose, or if you use your own insurance:

Price groupDeposit
Lowkey (under $100 a day)$150
Standard ($100 – $199 a day)$250
Premium ($200+ a day)$500

What the Security Deposit may be applied to. We may apply the Security Deposit to tolls, tickets and traffic violations, administrative fees, fuel or charging shortfalls, mileage overage, cleaning and smoking fees, damage, Loss of Use, and Diminished Value.

The Security Deposit is not applied to unpaid trip charges and does not reduce or satisfy the trip balance. Trip charges are payable separately.

Forfeiture. The entire Security Deposit is forfeited if you:

  • return the Vehicle with damage that occurred during the Rental Period;
  • operate the Vehicle at 100 miles per hour or more on three or more occasions; or
  • take the Vehicle outside the Service Area without our prior approval.

Forfeiture of the Security Deposit does not limit your liability. You remain responsible for all amounts owed in excess of the deposit.

Return of the deposit. Where no amounts are owed and no damage is found, we return the Security Deposit within 14 days of return and check-in, after toll charges post. If you return the Vehicle in person between 11:00 AM and 5:00 PM on a business day, we will return the deposit in cash the same day where a manager is available. Only the Guest may collect the Security Deposit.

Damage holds. Where damage not shown in the pickup Trip Photos is found, the Security Deposit is held until a repair estimate is obtained. We will not quote an amount before the estimate is complete.

9. RESERVATIONS

A Reservation Fee equal to the Security Deposit shown on the Rental Summary holds a specific vehicle for you.

No refunds once booked. Once your reservation is booked, nothing you have paid toward it is refunded if you cancel, change your plans, or do not take possession.

The Reservation Fee is NON-REFUNDABLE. If you cancel, or do not take possession, the Reservation Fee is retained and applied as credit toward a future trip with the Owner. It is not returned in cash.

If you take possession, the Reservation Fee converts into the Security Deposit for that trip.

Vehicle availability is not guaranteed until you take possession. If the reserved vehicle becomes unavailable, we will offer a vehicle of the same class at the same rate, transfer the Reservation Fee to another reservation, or hold it as credit, at your election.

10. RETURN, LATE RETURN, AND EXTENSIONS

Return. You must return the Vehicle to the location where you received it, or the location shown on the Rental Summary, on the date and time shown, in the same condition as received except for ordinary wear.

Grace period. You have a two (2) hour grace period after the scheduled return time at no charge.

Late return. After the grace period, you are charged the daily rental rate for each day or part of a day the Vehicle is not returned.

Automatic extension. If the Vehicle is not returned and the trip is not closed out within two (2) hours of the scheduled return time, the Rental Period automatically extends by one day, to 12:00 PM the following day, and you are charged accordingly. This repeats daily until the Vehicle is returned or recovered. You are responsible for all charges arising from an automatic extension.

Requesting an extension. To extend, contact Ridez at (954) 676-8128 before your return time. All extensions require our approval and payment in advance. An unpaid extension request is not an extension.

Extension pricing. Extensions are charged at the daily rate. A weekly or discounted rate applies only to the period for which it was purchased and does not carry into a day-by-day extension.

Return by another person. Another person may return the Vehicle, but only the Guest may collect the Security Deposit.

After-hours return. Vehicles may be returned after 11:00 PM by parking at our location and depositing the keys in our secured mailbox. You remain responsible for the Vehicle until we take possession, which occurs at 11:00 AM the next business day or upon completion of our return inspection, whichever is earlier.

Improper location return. If we must collect the Vehicle from a location other than the agreed return location, the fee in Section 20 applies.

Early return. No refund or credit is given for a trip returned before the scheduled return time.

11. TOLLS

The Vehicle is equipped with a SunPass transponder.

You will be charged three (3) times the amount of each toll charged to the Vehicle during your Rental Period.

This multiple covers the toll itself together with our administrative cost of identifying, matching, processing, and collecting it. You agree to this rate by signing this Agreement.

Toll charges may be applied against the Security Deposit or billed to you. Toll charges post on a delay and may be billed after the Rental Period ends.

Tickets and violations. All parking tickets, red-light and speed camera citations, moving violations, and toll-by-plate invoices incurred during the Rental Period are your responsibility, together with the administrative fee in Section 20 for each. Where a citation is issued to us, we will transfer it to you and charge that fee.

Impound. If the Vehicle is impounded, you are responsible for all impound, storage, and release costs, together with the administrative fee in Section 20.

12. FUEL AND CHARGING

Return the Vehicle with the same fuel or charge level it had at pickup, as recorded in the Rental Summary and Trip Photos.

  • Fuel shortfall: $6.00 per gallon.
  • Electric vehicle returned below its pickup charge level: $50.00.
  • Electrify America vehicles (BMW i7, Toyota bZ4X): you pay for charging directly at the station using your own payment method. No charging cost is billed to you afterward.
  • Tesla vehicles: Supercharging during the Rental Period is billed to our account and is charged back to you at actual cost, itemized.

13. TELEMATICS, VEHICLE DISABLING, AND RECOVERY

The Vehicle is equipped with telematics that allow us to determine its location and operating status and, where installed, to prevent the Vehicle from being restarted.

You expressly authorize us to disable the Vehicle's ability to restart if:

(a) any amount owed under this Agreement remains unpaid for more than twenty-four (24) hours and you have not committed to a payment we accept; or (b) the Vehicle is taken outside the Service Area without approval and the travel fee is not paid within one hour of our notice; or (c) the Vehicle is not returned within forty-eight (48) hours of the scheduled return time; or (d) the Vehicle is being used in material breach of Section 4.

Limits on disabling — we agree that:

  • We will not disable a Vehicle while it is in motion. The function prevents a restart only after the Vehicle has been parked and switched off by the driver.
  • We will attempt to contact you before disabling the Vehicle, and will tell you the amount owed and that the Vehicle will be disabled.
  • Once amounts owed are paid and confirmed, we will restore the Vehicle's operation. A reactivation fee applies as shown in Section 20.

Recovery. If the Vehicle is not returned as agreed, is abandoned, or is used in material breach of this Agreement, we may take possession of it without further notice to you and without legal process where permitted by law, and you are responsible for all costs of recovery. You agree to cooperate in the return of the Vehicle, including parking it in a lawful location and making the keys available to us.

14. INSURANCE

The Owner does not sell you insurance. The only limit on what you pay for damage is the cosmetic-damage cap of the protection plan you chose for the trip (Section 15).

You are not required to carry your own automobile insurance to book a trip. If you do, and you provide proof, your Security Deposit is still the amount shown on the Rental Summary, as Section 8 sets it, and your insurance is primary for any loss of or damage to the Vehicle. Liability to others follows the Liability to others paragraph below.

If you wish to purchase coverage for this trip, third-party products are available from providers such as RentalCover.com. We do not sell, endorse, or administer them, and any such policy is a contract between you and that provider.

Liability to others. The Shared Vehicle Owner's insurance pays first, then your own automobile insurance. When neither one covers the trip, or that coverage has lapsed, Ridez, as the car-sharing program, covers liability for bodily injury and property damage to others up to the minimum limits Florida law sets, as Fla. Stat. 627.7483 requires, and nothing above those limits.

You and we reject medical payments coverage to the extent permitted by law. Neither of us rejects the personal injury protection or the uninsured and underinsured motorist coverage that Fla. Stat. 627.7483 requires during each trip.

No insurance product is sold with this trip. Any mandatory charge appearing on the Rental Summary is a component of the trip price and does not provide, and must not be described as providing, insurance. The one limit on your responsibility for damage to or loss of the Vehicle is the cosmetic-damage cap of the protection plan you chose for the trip (Section 15). No other charge under this Agreement waives or limits that responsibility, and the cap never applies to mechanical or any other repair that is not cosmetic.

15. RESPONSIBILITY FOR DAMAGE OR LOSS

You are responsible for all damage to or loss of the Vehicle occurring during the Rental Period, regardless of fault, including damage from collision, theft, vandalism, weather, fire, flood, and acts of nature, except that what you pay for cosmetic damage is capped at the amount of the protection plan you chose for the trip. That cap is the one exception: mechanical repairs and every other repair that is not cosmetic are never capped. Where you carry insurance, it pays first.

Damage and repairs you cause are yours in full. You are fully responsible for the full cost of any damage to the Vehicle, and of any repair it needs, that is caused by you, by any driver you allow to operate it, or by your passengers during the Rental Period, including all applicable bills for repair, parts, labor, towing, and any related charges. The one exception is cosmetic damage: what you pay for cosmetic damage is capped at the amount of the protection plan you chose for the trip. Mechanical repairs, and every other repair that is not cosmetic, are never capped by any plan. Where you carry insurance, it pays first; any amount it does not pay is yours.

Where you carry insurance, that insurance is primary and you must promptly notify your insurer and cooperate with the claim. Where your insurance is insufficient or absent, you are responsible for the full cost of repair, subject only to the cosmetic-damage cap above, or the actual cash retail value of the Vehicle if it is not repairable or we elect not to repair it, plus Loss of Use, Diminished Value, towing, storage, and administrative costs.

Damage is determined by comparing the return Trip Photos against the pickup Trip Photos. Only damage not present at pickup is charged to you.

Tire damage from road hazards, curbs, or impacts is your responsibility where the pickup Trip Photos show adequate tread on all four tires and no tire-pressure warning was active at pickup.

Mechanical failure not caused by your use, misuse, or neglect is our responsibility. Where a mechanical failure that is not your fault takes the Vehicle out of service, we will provide a replacement vehicle where one is available and credit the days lost.

16. ACCIDENTS, THEFT, AND BREAKDOWN

In any accident, you must:

  • Check for injuries. Call 911 immediately if anyone is hurt.
  • Contact Ridez immediately at (954) 676-8128 — not later.
  • Remain at the scene until law enforcement arrives and obtain a police report or report number. Where law enforcement does not attend, file a Florida self-crash report.
  • Obtain the other driver's name, telephone number, insurance information, license plate, and vehicle description.
  • Photograph every vehicle involved, all damage, all license plates, the scene, and the other driver.
  • Send all photographs and information to us immediately.

Do not admit fault on our behalf. We handle all communication with other parties' insurers.

Theft or vandalism: notify us immediately. We file the police report.

Breakdown: stop driving the Vehicle if it is unsafe, move to a safe location, and contact Ridez at (954) 676-8128. Do not authorize any repair, towing, or service without our prior approval. Repairs made without our approval are not reimbursed.

Where a breakdown is not caused by your use, misuse, or neglect, we arrange and pay for towing. Where it results from your use, misuse, neglect, running out of fuel or charge, lockout, or a violation of this Agreement, those costs are yours.

Maintenance during long trips. For trips of 30 days or more, you must provide photographs of the instrument cluster and of all four tires every 30 days on our request, and present the Vehicle for scheduled maintenance at our location during business hours when a maintenance indicator appears. We pay for scheduled maintenance.

17. YOUR PROPERTY AND DATA

You release us from all claims for loss of or damage to personal property left in or carried in the Vehicle, whether or not caused by our negligence. No bailment is created for any property left in the Vehicle or on our premises.

Any personal data you transfer to the Vehicle's systems — contacts, call history, paired devices, navigation history — may remain accessible after the Rental Period. Delete it before returning the Vehicle. We are not responsible for data you leave behind.

18. BREACH AND TERMINATION

We may terminate this Agreement immediately and require the Vehicle's return if you breach any term, including non-payment, unauthorized use, unauthorized drivers, unauthorized travel, or submission of a falsified payment confirmation.

On termination, all amounts become immediately due, and our rights under Section 13 apply.

19. GENERAL

Entire agreement. The Rental Summary, this document, and the Fee Schedule are the entire agreement between you and us. All prior representations are superseded. No employee or representative of the Owner has authority to modify this Agreement orally.

Joint and several liability. Each person signing this Agreement and each Authorized Driver is jointly and severally liable for all obligations under it.

Indemnity. You agree to indemnify, defend, and hold us harmless from all claims, liability, costs, and attorney's fees arising out of this trip or your use of the Vehicle, except the minimum liability coverage Florida law requires of Ridez under Section 14.

Limitation. To the extent permitted by law, you release us from liability for consequential, special, or punitive damages in connection with this trip or any reservation.

No waiver. Our acceptance of a payment or our failure to exercise a right is not a waiver of that or any other right.

Severability. If any provision is held void or unenforceable, the remainder stays in force.

Governing law and venue. This Agreement is governed by the laws of the State of Florida. Venue for any dispute is Broward County, Florida.

Jury trial waiver. To the extent permitted by law, you and we each waive any right to a trial by jury in any proceeding arising out of this Agreement.

Version. This is version 3.13, effective October 20, 2026. It remains in effect until replaced. A later version applies only to trips booked after that version's effective date.

ACKNOWLEDGMENT

By signing below I confirm that I have read and accept this Agreement, that the information I provided is accurate, and that I understand in particular:

  • Tolls are charged at three times the toll amount (Section 11).
  • The Vehicle must stay within Miami-Dade, Broward, and Palm Beach Counties unless approved and paid for in advance, and that taking it outside forfeits my Security Deposit (Sections 6 and 8).
  • The Vehicle can be prevented from restarting if I owe money for more than 24 hours, and that a $100 reactivation fee applies (Section 13).
  • Only Authorized Drivers listed on this Agreement may drive, and a suspended or expired license means I may not drive at all (Section 3).
  • My trip extends automatically and I am charged for it if the Vehicle is not returned within 2 hours of the scheduled time (Section 10).
  • No refunds once booked, and the Reservation Fee is not refundable (Section 9).
  • No refund is given for an early return (Section 10).
  • The Owner does not sell you insurance. I have read the Liability to others paragraph in Section 14, and the only limit on what I pay for damage is the cosmetic-damage cap of the protection plan I chose (Sections 14 and 15).
  • I am responsible for all damage occurring during the Rental Period, and for the full cost of any damage or repair caused by me, a driver I allow, or my passengers, except that cosmetic damage is capped at the protection plan I chose; mechanical and all other repairs are never capped (Section 15).
  • My card is saved, and may be charged without asking me again for anything I owe under this Agreement, including damage, and held for the Security Deposit (Sections 7 and 8).
