1Who we are and what these terms cover

In shortRidez is a marketplace. Owners list their cars and guests rent them. These terms cover using the site; each trip also has its own rental agreement.

Ridez is run by Ridez Marketplace LLC, a Wyoming limited liability company ("Ridez", "we"). These terms apply when you browse, make an account, book a car, or list one.

A trip is between the guest and the car's owner. The rental agreement sets the rules for that trip. A host's relationship with Ridez is set by the host agreement. Where one of those says something different from these terms about a trip or a payout, that agreement wins.

2Your account

In shortUse your real name, keep your password to yourself, and tell us if someone else gets in.

You need an account to book or to list a car. The details on it must be true and kept up to date. You are responsible for what happens on your account. If you think someone else has used it, write to support@ridezrentals.com straight away.

3Who can book and who can drive

In shortOnly the drivers named on the rental agreement may drive, and each one must meet its age and license rules.

The rental agreement sets the minimum age for each kind of car, the licenses accepted, and how a driver is added. Every driver must show photo identification at pickup or at delivery.

Letting anyone else drive the car is a serious breach of the rental agreement and makes you responsible for what follows.

4Booking a car

In shortA booking is a request until it is confirmed. Once it is confirmed, the car is held for you.

Each listing shows the car, its price, its deposit and its rules. When a booking is confirmed you are sent the rental agreement for the trip, with a Rental Summary naming the car, the dates, the rates and the deposit.

If the car you booked becomes unavailable, the rental agreement says what you are offered instead.

5Prices, fees and paying

In shortThe price you see before you book is the price you pay for the trip. Charges after a trip follow the rental agreement's fee schedule.

Payments go through Stripe. Ridez never sees or keeps your full card number. The trip total, the deposit and every fee are shown before you send a request.

Charges that can only be known after a trip, such as tolls, fuel, late return or cleaning, are set by the fee schedule in the rental agreement.

6Cancelling and changing a trip

In shortNo refunds once booked. An extension has to be agreed and paid before the return time.

The cancellation policy sets out what happens to what you paid if you cancel, change your plans or return the car early. To extend a trip, contact us before the return time; an extension is approved and paid in advance.

7During the trip

In shortLook after the car, keep it where the rental agreement allows, and bring it back on time.

The rental agreement sets where the car may be driven, how it may be used, the mileage it includes, and the fuel or charge it must come back with. Breaking those rules can cost you your deposit.

8Damage, tolls, tickets and charges after a trip

In shortPhotos at pickup and return are the record. Damage, tolls and tickets from your trip are charged to you.

Damage is found by comparing the photos taken at the start and the end of the trip. Tolls, tickets, impound costs and the other charges in the rental agreement's fee schedule are charged after the trip, and may be taken from the deposit.

9Protection and insurance

In shortRidez sells no insurance. A guest's protection plan caps what they pay for cosmetic damage, and nothing else.

Ridez is not an insurance company and does not sell insurance. A guest chooses a protection plan for each trip; the one limit it puts on what the guest pays is the cap on cosmetic damage set out in the rental agreement. Mechanical and every other repair are never capped.

A host's car is covered by the Host Protection Plan, which is Part 2 of the host agreement. It is Ridez's own promise to repay damage to the car, not an insurance policy.

10Listing a car as a host

In shortA host lists a car under the host agreement, and is paid on the schedule it sets.

To list a car you accept the host agreement. It sets how your price works, when and how you are paid (section 8), the insurance you must carry, and the Host Protection Plan. A listing must describe the car truthfully and the car must be safe and kept in repair.

11What you may not do on Ridez

In shortNo false details, no fraud, no misuse of the site or of anyone's car.

You may not give false details, pay with a card or account that is not yours to use, send a fake payment confirmation, use a car for anything the rental agreement forbids, harass anyone you meet through Ridez, or try to get into parts of the site or accounts that are not yours.

12Reviews, photos and messages

In shortWhat you post must be true and yours to share. Ridez may remove what breaks these terms.

Reviews must be honest and about a real trip. Photos you upload of a car, damage or a document are kept as the record of the trip. Ridez may remove a review, photo or message that is false, abusive or breaks these terms.

13Privacy

In shortWhat Ridez collects about you, and who it is shared with, is on the privacy page.

The privacy page lists what we collect, why we collect it, who sees it, and how to have your account deleted.

14When Ridez closes an account

In shortRidez may pause or close an account that breaks these terms, an agreement, or the law.

We may pause or close an account that breaks these terms, the rental agreement, the host agreement or the law, or that puts a guest, a host or a car at risk. Money already owed stays owed. A host's agreement ends as the host agreement sets out.

15Disclaimers, the limits on what Ridez is responsible for, and what happens when a host, a guest or someone else causes a loss

In shortThe car's owner is responsible for the car. Ridez runs the booking and payment, and is not the owner or an insurer.

Ridez does not own the cars listed on it and sells no insurance. A loss caused by a guest, a host or someone else is dealt with under the rental agreement or the host agreement between the people involved. Where the law allows, Ridez is not responsible for indirect or consequential loss arising from using the site.

You will indemnify Ridez for economic loss Ridez suffers because you broke these terms or the rental agreement. This does not cover loss caused by Ridez's own negligence.

16Disputes

In shortIf we disagree, we first try to settle it together. If that fails, one arbitrator decides your own claim, with no jury and no class action; small claims court stays open, and you can opt out within 30 days.

Talk to us first. Before either of us starts a claim, the one with the complaint writes to the other and says what is wrong and what would put it right. You write to support@ridezrentals.com. We write to the email on your account. We then have 30 days to try to settle it.

Then binding arbitration. Any dispute between you and Ridez that is not settled in those 30 days is decided by binding arbitration, not in court. That covers these terms, the site, bookings, trips, payouts, the rental agreement and the host agreement. One arbitrator decides it, run by the American Arbitration Association under its Consumer Arbitration Rules. The hearing is in Broward County, Florida, or by phone or video. The arbitrator's decision is final, and a court can enforce it.

Only your own claim, and no jury. You and Ridez each bring claims only for yourselves. Neither of us may bring or join a class, collective or representative action against the other, and an arbitrator may not combine different people's claims. You and Ridez each waive the right to a jury trial.

Small claims court. Either of us may take a claim to small claims court instead, as long as it qualifies there and stays one person's claim.

You can opt out. You may opt out of this section within 30 days of the day you first agree to terms that include it. Email support@ridezrentals.com from the email on your account and say you opt out of arbitration. If you opt out, disputes go to the courts in Broward County, Florida. Nothing else in these terms changes.

Florida law. These terms are governed by the laws of the State of Florida, and the Federal Arbitration Act governs this section. If a court decides that the class action or jury waiver above cannot apply to a claim, that claim goes to the courts in Broward County, Florida, not to arbitration.

17Changes to these terms

In shortWhen these terms change, the new date is shown at the top. A trip keeps the rental agreement it was booked under.

We may update these terms, and the date at the top of this page shows when they last changed. A trip already booked keeps the rental agreement signed for it. Changes to the host agreement follow the notice it sets out.
